Understanding the Rules That a Process Server Must Follow
Process servers are expected to follow the letter of the law here in Florida. Not doing so can have dire consequences for any court case. At a minimum, the case may be rescheduled until proper process service can occur. At worst, the entire case may be dismissed! Either way, your firm’s clients are not likely to understand why their case is being delayed, and your reputation as their attorney could be tarnished.
Not only could your reputation take a hit, but case expenses will also likely soar as documents must be changed and dates are delayed. The entire flow of the court case will be halted while service of process issues are ironed out. Continue reading

Why Process Servers are Essential in the Legal Process
Service of Process is Your Constitutional Right
Process servers are some of the most important legal servants in the United States. Avoiding a Process Server Has Consequences
Avoiding a process server is a guaranteed way to make your upcoming court case more stressful and costly. Not to mention it could land you responsible for a default judgment that is far from being in your favor.
Too often, people make the mistake of thinking that if they avoid a process server for long enough, the case will just go away. While avoiding a process server will temporarily delay the case, there are ways to serve someone without physically handing them any paperwork. If a judge approves one of these alternative service methods, the defendant is considered served and the case will proceed. If the defendant continues to avoid the matter and doesn’t show up for the proceedings, a default judgment will be granted to the plaintiff. Default judgments will not be in your favor as the defendant and could end up costing you much more than if you had just handled the case properly. Continue reading

This is why for any claim over $8,000, the court recommends (but does not require) that you consult with an attorney to complete the required forms.
